STANDARD TERMS AND CONDITIONS OF JIMNY 4X4 RENTALS (PTY) LTD.
1. Rental of Vehicle
1. The Company rents the Vehicle and Package Equipment to the Renter for the Rental Period, subject to this Agreement and the Rental Agreement signed physically or electronically.
2. The Renter must inspect the Vehicle and Package Equipment before taking delivery and must ensure that the inspection checklist and inventory checklist are completed, photographed and signed.
3. The Company may refuse, cancel or withhold a rental if payment, documents, driver eligibility, security deposit, insurance requirements, credit checks or safety requirements are not satisfied.
4. The Company may terminate the Agreement and recover the Vehicle if the Renter breaches the Agreement, misuses the Vehicle, fails to pay, provides false information, exceeds territory limits or creates an unacceptable safety or insurance risk.
5. Any extension of the Rental Period must be requested at least 24 hours before the scheduled return time and is only valid once approved in writing and paid for.
2. Booking and Payment Terms
6. A 30% Booking Deposit is required to secure a reservation. The booking is not confirmed until the Company has received and allocated the deposit.
7. The remaining balance is due before collection or delivery. If full payment is not received on time, the Company may cancel the booking and apply the cancellation terms.
8. Bookings made within 7 calendar days of collection are also payable at 30% to confirm the booking and remaining balance due before collection or delivery can be done.
9. The Security Deposit is separate from the Booking Deposit and is payable or pre-authorised before the Vehicle is released.
10. All rates and charges are payable in South African Rand unless the Company agrees otherwise in writing. The Renter is responsible for bank charges, card fees, chargebacks and failed-payment costs.
11. Cash and cheques are not accepted unless expressly approved by the Company in writing.
3. Rates, Fees and Additional Charges
12. The Renter must pay all rental charges, delivery fees, security deposits, excess amounts, claims handling fees, traffic fine administration fees, cleaning charges, refuelling charges, late-return charges, missing-equipment charges, towing/recovery charges and other charges arising under this Agreement.
13. Daily rental is calculated on a calendar-day basis unless the quote states otherwise. Late return may be charged as an additional full day per calendar day or part thereof.
14. Cape Town International Airport delivery is Included in your price. After-hours airport delivery is R750 unless otherwise quoted. Depot collection is free during agreed business hours.
15. Cleaning, refuelling, smoking, lost-key, missing-equipment, unauthorised towing and damage administration charges are set out in Annexure B or the Rental Agreement.
16. The Renter may not deduct, withhold or set off any amount owing to the Company.
4. Availability and Replacement Vehicles
17. Specific colours, accessories, packages and models are subject to availability, maintenance, repairs, damage, late returns by prior renters and operational requirements.
18. The Company may provide a similar or better replacement vehicle where reasonably available. If a replacement is not reasonably available, the Company may offer a refund or credit for unused rental days, excluding damages or breach situations.
19. The green 3-door Jimny is a marketing/demo vehicle only and is not available for rental unless expressly recorded as the rental vehicle in a signed Rental Agreement.
5. Renter and Driver Eligibility
20. Every driver must be approved by the Company before driving the Vehicle. Unauthorised drivers are not permitted.
21. The standard minimum age is 21 years with a valid driver’s licence held for at least 3 years. Any exception must be approved in writing and may carry a surcharge or higher deposit.
22. Foreign drivers must present a valid licence in English or an official English translation/international driving permit where required.
23. Learner licences, expired licences, digital-only licences, photocopies or restricted licences may be refused.
24. The Renter is liable for the conduct, negligence, breach and charges of every Authorised Driver and any unauthorised person who gains access to the Vehicle.
6. Territory and Road Restrictions
25. At launch, Vehicles may be used in South Africa only. Cross-border travel is not permitted unless the Company and insurer approve it in writing before departure.
26. Vehicles may be used on tar roads, recognised gravel roads and public recognised 4x4 routes suitable for a Suzuki Jimny, provided the Renter drives carefully and within the stated speed guidance.
27. The Vehicle may not be used for dune driving, beach driving, saltwater driving, deep-water crossings, river crossings beyond safe shallow crossings, closed roads, private tracks without permission, racing, time trials, motorsport, towing, ride-hailing or transporting passengers/goods for reward.
28. The Company may restrict routes, regions or roads due to weather, fire, flooding, unrest, road conditions, insurance requirements or safety concerns.
29. Recommended maximum speeds are 100 km/h on tar roads, 60 km/h on gravel/corrugated roads and 40 km/h in national parks or on rough tracks, unless a lower legal limit or road condition requires lower speed.
7. Renter Obligations and Care of the Vehicle
30. The Renter must operate the Vehicle lawfully, safely and carefully and must comply with all traffic laws, parking rules, toll requirements and local regulations.
31. The Renter must check fuel level, tyre pressures, warning lights and obvious vehicle condition during the Rental Period, particularly before long trips and gravel-road travel.
32. The Renter must use the correct fuel only. Incorrect fuel, contaminated fuel and fuel-system damage are for the Renter’s account unless caused by the Company.
33. The Vehicle must be locked and secured when unattended. Keys must remain in the Renter’s possession and may not be left inside or on the Vehicle.
34. The Renter may not modify, repair, remove, disconnect or tamper with the Vehicle, tracker, dashcam, tyres, wheels, spacers, suspension, roof rack, accessories or stickers without written approval.
8. Pick-up, Handover and Defect Reporting
35. The Renter must allow sufficient time for handover, document verification, payment confirmation, inspection, package inventory and driving/use briefing.
36. Signing the inspection report confirms acceptance of the Vehicle’s recorded condition at handover.
37. The Renter must report any defect, malfunction, missing item, warning light or concern within 24 hours of collection or as soon as safely possible. Claims raised only at return may be rejected if timely reporting would have reduced loss or allowed repair.
38. Late collection or failure to collect does not entitle the Renter to a refund for lost rental days unless the Company caused the delay.
9. Cancellation and No-show Terms
39. Free cancellation is allowed up to 30 days before collection, subject to a R500 administration fee deducted from any refund.
40. Cancellation 14 to 30 days before collection: 50% of the Booking Deposit is refunded and 50% is retained as cancellation fee.
41. Cancellation less than 14 days before collection or no-show: the Booking Deposit is forfeited.
42. The Security Deposit is refundable if the rental does not proceed and no damage, costs, fines, chargebacks or unpaid amounts are outstanding.
43. Early returns and late collections are non-refundable unless the Company agrees otherwise in writing.
10. Return of Vehicle
44. The Renter must return the Vehicle at the agreed place, date and time with all keys, tools, documents, accessories and Package Equipment.
45. The Vehicle must be returned with a full fuel tank unless the Rental Agreement states otherwise. Refuelling shortages and refuelling service fees may be charged to the Renter.
46. The Vehicle must be returned with a clean inside and reasonably clean outside. Excessive dirt, sand, mud, stains, pet hair, food spills, smoke odour or equipment cleaning may attract a R500-R1250 cleaning charges.
47. No smoking or vaping is allowed in the Vehicle. Smoke odour, ash, burns or interior contamination, a penalty will be charged to the Renter at R5500.00.
48. Late return without approval will be charged at the daily rate plus any additional losses, administration costs, delivery disruption costs and replacement rental costs caused by the delay.
11. Risk, Damage and Security Deposit
49. Risk in the Vehicle and Package Equipment passes to the Renter from handover until the Company completes return inspection and accepts the Vehicle back.
50. The Renter is liable for damage, loss, theft, missing items, towing, recovery, storage and third-party claims to the extent allowed by law and subject to the insurance or waiver terms that apply.
51. The Company may deduct from the Security Deposit for damage, excess, unpaid charges, missing equipment, cleaning, refuelling, fines and administration fees. If losses exceed the Security Deposit, the Renter remains liable for the balance.
52. The Security Deposit will be released or refunded after return inspection and once reasonably satisfied that no further charges, fines, claims or damage assessments are pending. Bank/card-release timing depends on the financial institution.
53. Fair wear and tear is excluded from damage charges. Fair wear and tear does not include tyre/rim damage, glass damage, underbody damage, roof rack damage, dents, scratches, interior stains, smoke, lost keys or missing equipment.
12. Insurance, Waivers and Excess
54. Any insurance or waiver cover is subject to the Company’s actual insurer policy, the signed Rental Agreement and any selected waiver option. The Renter acknowledges that a waiver is not insurance.
55. The standard rental may include a compulsory base damage/theft waiver or insurance arrangement if stated in the Rental Agreement. The applicable Damage Liability Amount / Excess must be stated on the Rental Agreement before release.
56. The Renter remains fully liable where loss or damage is excluded, where the Renter breaches this Agreement, where a non-authorised driver drives, where use is outside approved territory or roads, or where the Renter acts unlawfully, recklessly, grossly negligently or intentionally.
57. Tyres, rims, glass, underbody, roof rack, accessories, interiors, keys, trackers, dashcams and Package Equipment are excluded from standard waiver cover unless the Rental Agreement expressly includes them.
58. Any replacement vehicle, if approved after an accident or breach, may be subject to a new Security Deposit, new excess and additional delivery/recovery charges.
13. Exclusions and Full Liability Events
59. The Renter may be fully liable for all damage, loss, theft, third-party claims and costs if any term of this Agreement is breached.
60. Full liability events include speeding, reckless driving, intoxicated driving, fatigue-related incidents, illegal use, unauthorised driver use, unauthorised cross-border travel, unapproved towing, racing, overloading, water or saltwater damage, underbody damage, driving on prohibited roads, failure to report an accident, leaving keys in or on the Vehicle, theft caused by negligence, and tampering with safety/tracking equipment.
61. Single-vehicle accidents, rollovers, hit-and-run incidents, theft/hijacking, uneconomical repair, tyre/rim/glass damage and underbody damage may carry special excess, double excess or full liability depending on the insurance terms and facts of the incident.
62. The Renter is liable for lost income, recovery, towing, replacement keys, locksets, storage, assessor fees, administration charges, claim-handling fees and diminished value where lawfully recoverable.
14. Package Equipment and Accessories
63. Package Equipment must be returned clean, complete and in good working order, fair wear and tear excepted.
64. Damage, loss, theft or misuse of accessories and Package Equipment is for the Renter’s account at replacement cost unless otherwise agreed in writing.
65. Adventure Package items may include roof rack, recovery strap, shackles, compressor, tyre repair kit, cooler box, chairs, table, storage box/bag and other listed items. The signed inventory is the controlling list.
66. The Renter may not use recovery equipment unless competent to do so and must not attempt unsafe recoveries. Damage caused during recovery attempts may be for the Renter’s account.
67. Rooftop loading, roof rack use and accessory use must follow the Company’s briefing and the manufacturer/installer limits. The Renter is liable for damage caused by overloading, striking overhead objects, misuse or failing to secure cargo.
15. Tyres, Wheels, Spacers and Suspension
68. Basic and Adventure vehicles may be fitted with General Grabber AT3 215/75R15 tyres, 32mm wheel spacers and Des Sol 50mm lift suspension or equivalent approved equipment.
69. The Renter must not remove, alter, loosen, swap or tamper with wheels, spacers, suspension or tyres except as necessary and safe to replace a flat tyre with the supplied spare.
70. The Renter must report punctures, tyre damage, wheel vibration, steering pull, warning lights, wheel noise or any suspected loose wheel/spacer immediately and must stop driving if continued use may be unsafe.
71. Punctures, tyre sidewall damage, rim damage, balancing, alignment damage and damage caused by low pressure, overloading or negligent gravel-road driving are for the Renter’s account unless caused by a pre-existing defect recorded at handover.
72. Any replacement tyre must be new, of the same size, load/speed rating and suitable type as approved by the Company. Used, retreaded or mismatched tyres are not accepted unless the Company approves in writing for emergency use only.
16. Vehicle Repairs and Roadside Assistance
73. The Renter must contact the Company before authorising repairs, towing, recovery or roadside work, except in a genuine emergency where immediate action is necessary to prevent further loss or ensure safety.
74. Repairs up to R1,500 may be approved by the Company by WhatsApp or phone and may be reimbursed only if original receipts, photos and approval evidence are provided. Repairs above R1,500 require written approval before work begins.
75. Unauthorised towing, unauthorised repairs and unauthorised call-out fees may be rejected and charged to the Renter.
76. If a mechanical failure not caused by the Renter makes the Vehicle unusable, the Company will use reasonable efforts to repair or replace the Vehicle as soon as practical. The Company is not liable for indirect loss, missed bookings, accommodation, flights or consequential loss unless required by law.
17. Tracking, Dashcams and Personal Information
77. Vehicles may be fitted with GPS tracking, telematics, immobilisation, dashcam or similar systems for safety, security, recovery, fleet management, insurance, route verification and breach investigation.
78. By signing the Agreement, the Renter consents to the Company processing personal information, driver information, contact information, licence/passport/ID information, payment information, location data, trip records, incident information and fine/claim information for rental, insurance, security, legal and debt-recovery purposes.
79. The Company may disclose relevant personal information to insurers, brokers, tracking providers, payment providers, police, traffic authorities, legal advisors, debt collectors, recovery agents, repairers and other parties with a legitimate rental-related need.
80. The Renter must ensure that every Authorised Driver and passenger is aware that the Vehicle may be tracked and that trip/location data may be processed for the purposes stated above.
81. The Company must take reasonable steps to protect personal information and retain it only for lawful business, accounting, insurance, fraud-prevention, claims, dispute and legal purposes.
18. Traffic Fines, Tolls and Infringements
82. The Renter is liable for all traffic fines, e-tolls, parking fines, impound fees, congestion/permit charges, road-user charges and related administration fees incurred during the Rental Period.
83. The Company may nominate the Renter or Authorised Driver to the relevant authority and may disclose personal information for that purpose.
84. The Company may charge the Renter a traffic-fine administration fee for each infringement processed.
85. The Renter remains liable for fines received after the Security Deposit has been released and authorises the Company to recover such amounts where lawfully permitted.
19. Accident, Theft and Incident Procedure
86. In an accident, theft, hijacking, fire, vandalism, animal impact or third-party incident, the Renter must stop where safe, secure people first, contact emergency services if needed, notify the Company as soon as possible and no later than 3 hours after becoming aware of the incident.
87. The Renter must report accidents, theft, hijacking, fire, vandalism and third-party incidents to the South African Police Service within 24 hours and obtain a case number where required.
88. The Renter must not admit liability, settle claims, release parties, abandon the Vehicle, authorise towing without approval or sign documents that prejudice the Company or insurer.
89. The Renter must collect names, contact details, vehicle registrations, licence details, witness details, photos and police/incident numbers, and must complete the Company’s claim forms truthfully.
90. Failure to follow the incident procedure may result in full liability and loss of waiver/insurance benefits.
20. Force Majeure
91. The Company is not liable for delay, cancellation or failure to perform caused by events beyond reasonable control, including severe weather, flood, fire, road closure, civil unrest, strike, epidemic, law, fuel shortage, supplier failure, vehicle damage by a prior renter or insurer restrictions.
92. Where a force majeure event affects a confirmed booking, the Company may offer a replacement vehicle, date change, credit or refund for unused rental charges as reasonably appropriate, subject to costs already incurred and applicable law.
21. General Legal Provisions
93. This Agreement is the entire agreement between the parties regarding the rental and replaces prior oral or written statements, except the signed Rental Agreement, quotation, invoice and annexures forming part of it.
94. No amendment, waiver or extension is valid unless recorded in writing by the Company.
95. This Agreement is governed by the laws of the Republic of South Africa.
96. The parties consent to the jurisdiction of the Magistrates’ Court where legally permitted, without excluding the Company’s right to approach any competent court.
97. If any clause is invalid or unenforceable, the remaining clauses remain valid to the fullest extent allowed by law.
98. The Renter is liable for legal fees, collection commission, tracing fees and recovery costs on an attorney-and-client scale where the Company must take steps to recover amounts owing, to the extent lawfully recoverable.
98. All our contractual relations will be governed exclusively by South Africa law.
